Article 1 — Definitions
- "Tugaskita" refers to Tugaskita, a provider of website development and digital solutions.
- "Client" refers to any individual or business entity that uses Tugaskita’s services.
- "Services" refers to all services offered by Tugaskita, including but not limited to website development, information systems, and AI integration.
- "Project" refers to a single unit of work agreed between Tugaskita and the Client.
Article 2 — Scope of Services
- The scope of each Project (features, number of pages or modules, integrations, and estimated timeline) is set in a written proposal approved by the Client.
- Work outside the proposal is treated as a change request, and its cost and timeline are agreed separately before the work starts.
- The initial consultation is free and does not oblige the Client to order.
- Answers from the AI chat assistant on the website are general information and are not binding. What applies is the written proposal and what is agreed directly with the Tugaskita team.
Article 3 — Fees and Payment
- Project fees follow the approved proposal and are charged in Indonesian Rupiah (IDR).
- Payment consists of a down payment at the start and the balance before the Project goes live or is handed over. Larger projects can be paid in stages as set in the proposal.
- Work starts once the down payment is received. Payment is made by bank transfer to the account stated in the proposal or invoice.
- Fees for ongoing services such as hosting, domains, or maintenance, if any, are agreed separately.
Article 4 — Timeline
- The estimated timeline is stated in each Project proposal.
- Tugaskita shows progress regularly so the Client can give feedback from the start.
- Delays caused by the Client, such as materials not being ready or late feedback, may move the completion date.
Article 5 — Revisions
- The number of revisions included in the fee follows the proposal.
- A revision is a correction to agreed features. New features or major changes to the scope are treated as a change request.
- Revisions beyond the agreed number may incur an extra fee, confirmed in advance.
Article 6 — Intellectual Property and Source Code
- The source code of a Project built specifically for the Client is handed over after full payment and belongs entirely to the Client.
- Tugaskita may reuse general components, libraries, and know-how that are not specific to the Client.
- Third-party assets such as fonts, icons, images, or libraries are subject to their owners’ licenses.
- Tugaskita only shows a Project in its portfolio with the Client’s permission.
Article 7 — Warranty and Support
- Tugaskita provides a bug-fix warranty for the delivered features, for the warranty period stated in the proposal.
- The warranty does not cover new feature requests, changes made to the system by others, or outages of third-party services.
- Handover includes joint testing, training, and a usage guide. Support after the warranty period can be agreed separately.
Article 8 — Cancellation
- The Client may cancel a Project by notifying Tugaskita in writing.
- Work completed up to the cancellation date remains payable by the Client and is offset against payments already received.
- Any refund is agreed together based on the progress of the work.
Article 9 — Client Obligations
- To provide accurate and complete materials and information on time.
- To be responsible for the content they provide (text, photos, logos, and so on) and to make sure it does not break the law or infringe the rights of others.
- To keep system accounts and passwords confidential after handover.
Article 10 — Limitation of Liability
- Tugaskita is not liable for indirect losses, lost profits, or losses caused by third parties, including outages of hosting providers, WhatsApp, or AI services.
- Tugaskita’s maximum liability is limited to the contract value of the Project concerned.
Article 11 — Force Majeure
- Neither party is considered at fault for delays caused by events beyond their control, such as natural disasters, widespread network outages, or government policy.
- The affected party notifies the other as soon as possible, and the timeline is adjusted together.
Article 12 — Dispute Resolution
- Any dispute is first settled through amicable discussion.
- These terms and conditions are governed by the laws of the Republic of Indonesia.
Article 13 — Changes to These Terms
- Tugaskita may update these terms and conditions at any time. The date of the latest update is shown at the top of this page.
- If this document and an approved proposal differ, the proposal prevails for that Project.
